Papal Mass Music - copyright

Following the printing of (reportedly) 1,000,000 copies of the Magnificat booklet, and the fact that downloadable pdf doesn't say anything about not printing it, does anybody know what the position is regarding using the MacMass afterwards?

Have to confess, I'm still in 2 minds about it - I'm not fond of it, but I think SC was overstating to say that only masochists would use it in future and I think it's growing on me.

It would be illicit to use this setting before the text it sets is officially implemented on the instruction of our bishops. The earliest date for this is September 2011.

This of course has no bearing on copyright, which I understand from 'Magnificat' resides both with the composer and the publisher. As far as I know, neither are covered by the usual copyright license schemes so permission would have to be sought seperately if one wanted to reproduce the melody line for the congregation once the text is licit. Boosey and Hawkes' website does have a licensing section and I'd be interested to know what the charges would be.

B&H tried to charge Magnificat £10,000 to include it. This sum was later reduced to £5,000.

MacMillan is reported on another forum as not accepting a penny himself for this usage. If true, this means that B&H are lining their pockets at the expense of the Catholic community.

As a copyright holder (p274, responsorial psalm at Cofton Park), I have not been approached for permission to include my work in the Magnificat booklet. On a pro rata basis, based on the fee SC reports to have been paid to B&H, I should expect about £150. I'm not holding my breath…

There is a Calamus/Decani acknowledgement. Are you covered by that?

The choirs at Bellahouston and Cofton Parks are going to be instructed to destroy their copies of the MacMillan after the events. Permission was given by Boosey and Hawkes to copy for one time use only. So it's wait until publication (which will be without the repeats) and buy copies.

There is no Calamus acknowledgement on my piece - I have no agreement with Calamus to handle my copyright. I've been assured this morning that all is being sorted.

Any news as yet? We are planning to use your psalm response as printed in the Magnificat booklet on the 19th - and I doubt if we are the only parish planning to do this. Would you prefer us not to use it if it has been illegally printed?

I can't stop you using the psalm - indeed, in many ways I am honoured to be able to serve the Church in this way. My point really is more that in the organisation of this event, things like copyright should be got right.

If you PM me, I'll send you the music for the verses too, and permission to copy and use it. If that helps

We have got piles of the booklet. They were advised to be sold for £2.00 but today they were trying to give them away for free.

Do they have to be destroyed then? (Imagines using them as firelighters..... ).
